Step 1 - Are You Eligible to Contest a Will?
The first consideration when disputing a will is establishing your eligibility to do so. Not just anyone can contest a will, you have to be a person who was in a certain relationship with a deceased person.
The categories of eligibility in each state are:
Queensland
- a spouse (including de facto and same sex partners);
- a child (including stepchild);
- a dependant.
New South Wales
Victoria
